However, authorities which may receive personal data in the context of a specific investigation mandate under Union or national law shall not be considered as recipients.

Third party means any natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorized to process the personal data.

We send newsletters, e-mails and other electronic notifications containing advertising information (hereinafter “newsletters”) only with the consent of the recipients or a legal permission. If the contents of the newsletter are specifically described in the context of a registration for the newsletter, they are decisive for the consent of the users. In addition, our newsletters contain information about gold, silver, coins, barrem, gold knowledge, price developments, and other topics in the field of precious metals as well as about Gold&Co (this may include in particular references to blog posts, offers or other services).
Use of the dispatch service provider “MailChimp”
The newsletters are sent via “MailChimp”, a newsletter dispatch platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.
The e-mail addresses of our newsletter recipients, as well as their other data described in this notice, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore MailChimp may use this data according to its own information to optimize or improve its own services, e.g. for technical optimization of sending and presentation of the newsletters or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them or pass them on to third parties.
We trust in the reliability and the IT and data security of MailChimp. MailChimp is Mailchimp is certified since November 2016 (https://www.privacyshield.gov/participant?id=a2zt0000000TO6hAAG&status=Active) under the US-EU data protection agreement “Privacy Shield” and is committed to comply with the EU data protection regulations. Furthermore, we have concluded a “Data-Processing-Agreement” with MailChimp. This is a contract in which MailChimp commits itself to protect the data of our users, to process it according to its data protection regulations on our behalf and especially not to pass it on to third parties. Double-Opt-In and Protocolling
The registration to our newsletter is done in a so-called double opt-in procedure. This means that after registration you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that nobody can register with foreign e-mail addresses.
The registrations for the newsletter are logged in order to be able to prove the registration process according to the legal requirements. This includes the storage of the time of registration and confirmation as well as the IP address. Changes to your data stored with MailChimp are also logged.
Registration data
To subscribe to the newsletter, it is sufficient to enter your e-mail address. Optionally we ask you to enter your first and last name. This information is only used to personalize the newsletter. Furthermore, we also optionally ask you to enter your website. We only use this information to adapt the contents of the newsletter to the interests of our readers.
Statistical survey and analyses
The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file which is retrieved from the server of MailChimp when the newsletter is opened. In the context of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval are collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined by means of the IP address) or the access times.
Statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our ambition nor that of MailChimp to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our contents to them or to send different contents according to the interests of our users.
Online access and data management
There are cases where we direct the newsletter recipients to the websites of MailChimp. E.g. our newsletters contain a link with which the newsletter recipients can retrieve the newsletters online (e.g. in case of display problems in the e-mail program). Furthermore newsletter recipients can correct their data, e.g. the e-mail address, afterwards. Likewise the privacy policy of MailChimp is only available on their site.
In this context we would like to point out that on the websites of MailChimp cookies are used and therefore personal data is processed by MailChimp, its partners and service providers (e.g. Google Analytics). We have no influence on this data collection. Further information can be found in the privacy policy of MailChimp. We would also like to draw your attention to the possibility to object to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European area).
Cancellation/Revocation
You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. Your consent to receive the newsletter via MailChimp and the statistical analyses will expire at the same time. A separate cancellation of the dispatch via MailChimp or the statistical analysis is unfortunately not possible.

Legal basis Basic data protection regulation
In accordance with the provisions of the Basic Data Protection Regulation (DSGVO), which will come into force on 25 May 2018, we hereby inform you that consent to the sending of e-mail addresses is given on the basis of Art. 6 Para. 1 lit. a, 7 DSGVO and § 7 Para. 2 No. 3, or Para. 3 UWG. The use of the mail service provider MailChimp, the execution of statistical surveys and analyses as well as the logging of the registration procedure are based on our legitimate interests according to art. 6 para. 1 lit. f DSGVO. We are interested in the use of a user-friendly and secure newsletter system that serves our business interests and meets the expectations of the users.
We would also like to point out that you can object to the future processing of your personal data in accordance with the legal requirements pursuant to Art. 21 DSGVO at any time. The objection can be made in particular against processing for the purposes of direct advertising.
6. POSSIBILITY OF CONTACT VIA THE INTERNET SITE
Due to legal regulations, the website of Gold & Co Luxury Goods Handels GmbH contains information that enables a quick electronic contact to our company as well as a direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). 8. RIGHTS OF THE PERSON CONCERNED
A. RIGHT TO CONFIRMATION
Every data subject has the right, granted by the European Directive and Regulation, to obtain from the controller confirmation as to whether personal data relating to him or her are being processed. If a data subject wishes to exercise this right of confirmation, he or she may at any time contact our Data Protection Officer or any other employee of the controller.
B) RIGHT TO INFORMATION
Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain at any time and free of charge from the data controller information on personal data relating to him/her and a copy thereof. The European Data Protection Supervisor has also granted the data subject access to the following information:
the purposes of processing
the categories of personal data processed
the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular to recipients in third countries or international organisations
if possible, the planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining this duration
the existence of a right of rectification or erasure of personal data relating to him or her or of a restriction on processing by the controller or a right to object to such processing
the existence of a right of appeal to a supervisory authority
if the personal data are not collected from the data subject: All available information on the origin of the data
the existence of automated decision-making, including profiling, in accordance with Article 22(1) and (4) of the DPA and, at least in these cases, meaningful information on the logic involved and the scope and intended impact of such processing on the data subject
The data subject shall also have the right to obtain information as to whether personal data have been transferred to a third country or to an international organisation. If this is the case, the data subject shall also have the right to obtain information on the appropriate safeguards relating to the transfer.
If a data subject wishes to exercise this right of access, he or she may at any time contact our Data Protection Officer or any other employee of the controller.
C) RIGHT OF CORRECTION
Any person affected by the processing of personal data has the right, granted by the European legislator, to request the rectification without delay of inaccurate personal data concerning him. The data subject shall also have the right to obtain the completion of incomplete personal data, including by means of a supplementary declaration, having regard to the purposes of the processing.
If a data subject wishes to exercise this right of rectification, he or she may at any time contact our Data Protection Officer or any other employee of the controller.
D) RIGHT OF DELETION (RIGHT TO BE FORGOTTEN)
Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain from the controller the immediate erasure of personal data relating to him/her, if one of the following reasons applies and provided that the processing is not necessary:
The personal data have been collected or otherwise processed for purposes for which they are no longer necessary.
The data subject withdraws the consent on which the processing was based pursuant to Article 6(1)(a) of the DPA or Article 9(2)(a) of the DPA and there is no other legal basis for the processing.
The data subject lodges an objection to the processing pursuant to Article 21 (1) DPA and there are no overriding legitimate reasons for the processing, or the data subject lodges an objection to the processing pursuant to Article 21 (2) DPA.
The personal data were processed unlawfully.
The deletion of the personal data is necessary to comply with a legal obligation under Union law or the law of the Member States to which the controller is subject.
The personal data was collected in relation to information society services offered in accordance with Article 8 (1) of the DS-GVO.
If any of the above reasons apply and a data subject wishes to request the deletion of personal data stored by Gold & Co Luxury Goods Handels GmbH, he/she may at any time contact our data protection officer or any other employee of the data controller. The data protection officer of Gold & Co Luxury Goods Handels GmbH or another employee will arrange for the deletion request to be complied with immediately.

F) RIGHT TO DATA TRANSFERABILITY

Furthermore, when exercising their right to data transfer pursuant to Art. 20 Para. 1 DPA, the data subject has the right to request that personal data be transferred directly from one controller to another controller, insofar as this is technically feasible and provided that this does not adversely affect the rights and freedoms of other persons.
In order to assert the right to data transfer, the person concerned can contact the data protection officer appointed by Gold & Co Luxury Goods Handels GmbH or another employee at any time.
G) RIGHT TO CONTRADICTION
Every person concerned by the processing of personal data has the right, granted by the European legislator, to object at any time, for reasons arising from his or her particular situation, to the processing of personal data concerning him or her carried out pursuant to Article 6(1)(e) or (f) of the DPA. This also applies to profiling based on these provisions.
In the event of an objection, Gold & Co Luxury Goods Handels GmbH will no longer process the personal data unless we can prove compelling reasons for processing worthy of protection that outweigh the interests, rights and freedoms of the person concerned, or the processing serves to assert, exercise or defend legal claims.

Where the decision is (1) necessary for the conclusion or performance of a contract between the data subject and the controller, or (2) is taken with the express consent of the data subject, Gold & Co Luxury Goods Handels GmbH shall take appropriate measures to safeguard the rights and freedoms and legitimate interests of the data subject, including at least the right to obtain the intervention of the controller, to put forward his point of view and to challenge the decision.

I) RIGHT TO WITHDRAW DATA PROTECTION CONSENT

If the data subject wishes to exercise his or her right to withdraw consent, he or she may at any time contact our Data Protection Officer or any other employee of the controller.
9. DATA PROTECTION IN APPLICATIONS AND IN THE APPLICATION PROCESS
The controller collects and processes the personal data of applicants for the purpose of processing the application procedure. The processing may also be carried out by electronic means. This is particularly the case if an applicant submits relevant application documents to the controller electronically, for example by e-mail or via a web form on the website. If the data controller concludes an employment contract with an applicant, the transmitted data is stored for the purpose of processing the employment relationship in accordance with the statutory provisions. If the controller does not conclude an employment contract with the applicant, the application documents are automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests of the controller conflict with deletion. Other legitimate interests in this sense include, for example, an obligation to provide evidence in proceedings under the General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz, AGG).

Each time the data controller calls up one of the individual pages of this website, which is operated by the data controller and on which a Facebook component (Facebook plug-in) has been integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Facebook component to download a display of the corresponding Facebook component from Facebook.
